1.Making your Booking:
Any contract for the supply of our DJ services is between you and Trevor Matthews T/A Midland DJs. In order to secure your booking you must agree to these terms and conditions by paying your booking/processing fee (which will be an agreed amount of the total booking cost). Once we receive your booking/processing fee payment, a confirmation will be issued to you. A contract for the booking shall come into effect immediately upon Confirmation. Confirmation will mean any verbal, electronic or written acceptance of this booking by the ‘client’ and Midland DJs. All bookings take effect immediately upon confirmation.
2.Changes to the booking:
The Booking may be subject to change (in agreement with both the Client’ and Midland DJs) if any details of the booking are altered by the Client such as the event times, event type and event venue. All changes to the booking must be arranged and agreed by Midland DJs in advance of the event.
3.Payment of the Booking Fee/Processing Fee:
The agreed booking fee/processing fee is due at time of booking. The booking fee/processing fee must be received by Midland DJs for the booking to take effect. This is a non-refundable fee charged for booking administration, any initial preparatory work to include arranging transport, dedicating time to a playlist, calls & meetings etc. This fee must be paid on acceptance of the terms and conditions herein and a booking confirmation will be issued. Booking fees can be paid via paypal or electronic online bank transfer. All fees are charged in Euro.
4.Payment of Balance:
All fees are charged in Euro. The balance is payable to Midland DJs in cash on the day/night of the event or in advance by online bank transfer. Advance online bank transfer must be made no later than 14 days before the event. Cheques or postal orders are not accepted. Payments on the night are paid in cash only and in advance of commencement of DJ performance. Any additional performance time must be paid prior to the performance continuing. Overtime is charged at €200.00 per hour. Midland DJs does not play after 2.00am unless agreed/spoken about in advance. Playing time after 2.00am is charged at the above rate. In the event of non-payment Midland DJs retain the right to attempt collection through the courts. Purchaser will be held responsible for all court fees, legal fees, and collection costs incurred. Payment of additional performers such as Sax Player or bongo player is cash payment only on the day of the event only.
Cancellation by the ‘client’ will result in the loss of any booking/processing fee paid. Cancellation 60 days prior to the date will require 50% of the balance to be paid. If a new date is sought and Midland DJs are available for said date then the booking/processing fee can be carried forward to the new date. However, in the event that prior engagements have been made by Midland DJs and he is obliged to fulfil other events and are unavailable for the event in question the booking/processing fee will be withheld by Midland DJs. In the unlikely event that Midland DJs cancels the booking, Midland DJs agree to inform the ‘client’ of the cancellation immediately and will make all reasonable attempts to find a suitable replacement artist of similar standard and style, at no extra cost to the ‘client’. The ‘client’ may also opt for a full refund if such a scenario arises.
As per the Consumer Protection Act, 2007 this agreement shall have a 14 day cooling-off period and as such the ‘client’ may cancel same at any point in that period and avail of a full refund to include booking/processing fee.
6.Changes on the day:
Where possible, changes to the contract schedule which are unavoidable on the day of the event should first be discussed & agreed with Midland DJs. Should this not be possible, changes are to be agreed between the ‘client’ and Midland DJs prior to the performance. Any changes will be subject to these terms and conditions. Changes negotiated between the ‘client’ and Midland DJs on the day of the event and any extra fees are agreed upon, the ’client’ must pay these extra fees along with the remaining balance of the booking. In the event Management at the venue requires without prior notice Midland DJs to terminate the performance pre- maturely for reasons outside Midland DJs control a refund will not be given. (Refer to event details for times agreed).
It is agreed by the ‘client’ and Midland DJs that the equipment of Midland DJs is not available for use by other performers or persons except by specific permission of Midland DJs.
The Client realises that whilst every reasonable safeguard is assured, the breakdown of any electrical equipment can be an unavoidable occurrence and is often outside of my control. I will however make every reasonable effort to rectify the situation. In the extremely unlikely occurrence of a non-performance, or if a total failure occurs, The Client will be refunded in full. In this situation, this will be the full extent of my liability.
8.Withdrawal of Services:
In case of verbal and/or physical violence towards the DJ or any person/persons connected with Midland DJs, the Client may be asked to have this/these people removed from the venue. If an agreement regarding this cannot be resolved then the services of Midland DJs may be stopped, and the Client will be liable for the remainder of the event Fee due plus any other costs or expenses incurred by Midland DJs as a result.
In the case of damage being caused to any equipment (either belonging to, contracted to or leased to Midland DJs) by the Client or any person/person’s at the event the services of Midland DJs may be stopped, and the Client will be liable for the remainder of any Fee due. The Client will also be fully liable to reimburse Midland DJs for any damage to equipment within 7 days of the event date.
Midland DJs will not be held responsible for reduced playing times or a later than anticipated start time due to delays in the serving of the meal, lengthy speeches, absence of an area to set up in or any other factor outside of his control. Any delays that coincide with our expected playing time are considered to be part of the playing time. It is understood that, depending on the equipment requirements of the room, set up may require up to 60 mins.
The Client undertakes the responsibility for ensuring that Midland DJs is given access to the venue and use of working mains electricity supply on their arrival. Midland DJs assumes the event venue meets the electrical safety standards to operate the Client’s selected package. In the event of any electrical risks being posed, Midland DJs has the discretion to reduce the size of the Client’s selected package in order to operate safely. The Client will continue to be liable for the agreed sum of the selected package.
Midland DJs will not accept any liability for power cuts which interrupt the service provided, however, will endeavour to cooperate with the venue to try and rectify any problems. The Client understands that no compensation or price reduction will be given for power cut issues.
Venue Restrictions – The Client will be responsible for checking and resolving any limits or restrictions attached to the venue, which could negatively impact on the ability of Midland DJs to carry out their services. This includes devices such as sound limitation monitors.
Recording – Midland DJs may use video and picture from you event for social media and promotional purposes.
10.Limitation of Liability:
We disclaim any and all liability to you for the DJ services to the fullest extent permissible under applicable law. This does not affect your statutory rights as a consumer. If we are found liable for any loss or damage to you such liability is limited to the amount you have paid for the DJ service. We cannot accept any liability for any loss, damage or expense, including any direct or indirect loss such as loss of profits, to you howsoever arising. This limitation of liability does not apply to personal injury or death arising as a direct result of our negligence.
Terms used in this document shall have the following meanings:
“Booking Fee” means the fee as notified to you by us for the booking;
“Client”, “you”, “your” or “yours” means you, the person booking our services;
“Confirmation” means any verbal, electronic or written acceptance of the booking by Midland DJs;
“Terms and Conditions” means the terms and conditions upon which the booking for DJ services is made and which is set out in this document;
“Trevor Matthews”, “Midland DJs”, “us”, ”our”, “me”, “DJ” or “we” means Trevor Matthews of Midland DJs.
